UPDATES ON (1) KUALA LUMPUR HIGH COURT CIVIL SUITS BETWEEN MALAYSIA AIRPORTS (SEPANG) SDN BHD AND AIRASIA BERHAD (2) KUALA LUMPUR HIGH COURT CIVIL SUIT BETWEEN MALAYSIA AIRPORTS (SEPANG) SDN BHD AND AIRASIA X BERHAD
We refer to our Announcement dated 11 April 2022.
The Board of Directors of Malaysia Airports Holdings Berhad (“the Company”) wishes to announce that on 9 August 2022, AirAsia Berhad and AirAsia X Berhad (collectively, “AirAsia”) filed Notices of Discontinuance to withdraw without liberty to file afresh its Notices of Motion for Leave to Appeal to the Federal Court against the decision of the Court of Appeal dated 3 March 2022.
The Court of Appeal had upheld the order of the Kuala Lumpur High Court dated 18 July 2019 which had granted summary judgment in favour of Malaysia Airports (Sepang) Sdn Bhd (“MA Sepang”), a wholly owned subsidiary of the Company, for unpaid Passenger Service Charges and Late Payment Charges in three civil suits filed by MA Sepang against AirAsia. The Court of Appeal had further upheld the order of the Kuala Lumpur High Court dated 18 July 2019 to dismiss AirAsia’s applications to strike out MA Sepang’s three civil suits.
UPDATES ON SUIT AGAINST MALAYSIA AIRPORTS (SEPANG) SDN BHD BY AIRASIA BERHAD AND AIRASIA X BERHAD
We refer to our Announcements dated 11 April 2022, 29 March 2022 and 17 October 2019.
The Board of Directors of the Company wishes to announce that on 9 August 2022, AirAsia filed a Notice of Discontinuance to withdraw without liberty to file afresh its civil suit against MA Sepang in respect of alleged losses and damages in the sum of RM479,781,285.00 (“the Civil Suit”).
Further, on 9 August 2022, MA Sepang filed a Notice of Discontinuance to withdraw without liberty to file afresh its Notice of Appeal against the decision of the Kuala Lumpur High Court on 25 March 2022 to dismiss an application by MA Sepang to strike out the Civil Suit.
UPDATES ON KUALA LUMPUR HIGH COURT CIVIL SUIT BETWEEN MALAYSIA AIRPORTS HOLDINGS BERHAD, MALAYSIA AIRPORTS (SEPANG) SDN BHD, AIRASIA BERHAD, AIRASIA X BERHAD, RIAD ASMAT AND BENYAMIN BIN ISMAIL
The Board of Directors of the Company wishes to announce that on 9 August 2022, the Company and MA Sepang filed a Notice of Discontinuance to withdraw without liberty to file afresh its Kuala Lumpur High Court Civil No. WA-23CY-8-02/2019 which had been filed on 19 February 2019 against AirAsia Berhad, AirAsia X Berhad, Riad Asmat and Benyamin Bin Ismail for alleged defamation.
With the filing of the aforesaid Notices of Discontinuance, the Company is pleased to announce that there will no longer be any legal proceedings or material litigation pending between the Company, MA Sepang, AAB and AAX.
Any further updates in respect of any material development will be made from time to time.
