We refer to our Announcement dated 3 March 2022.

The Board of Directors of Malaysia Airports Holdings Berhad (“the Company”) wishes to announce that on 1 April 2022, AirAsia Berhad and AirAsia X Berhad (collectively, “AirAsia”) filed Notices of Motion for leave to appeal to the Federal Court against the decision of the Court of Appeal dated 3 March 2022.

The Court of Appeal had upheld the order of the Kuala Lumpur High Court dated 18 July 2019 which had granted summary judgment in favour of Malaysia Airports (Sepang) Sdn Bhd (“MA Sepang”), a wholly owned subsidiary of the Company, for unpaid Passenger Service Charges and Late Payment Charges in three civil suits filed by MA Sepang against AirAsia Berhad and AirAsia X Berhad. The Court of Appeal had further upheld the order of the Kuala Lumpur High Court dated 18 July 2019 to dismiss AirAsia’s applications to strike out MA Sepang’s three civil suits.
