We refer to our Announcements dated 18 July 2019, 22 July 2019 and 20 September 2019. 

The Board of Directors of Malaysia Airports Holdings Berhad (“the Company”) wishes to announce that on 3 March 2022, the Court of Appeal upheld the order of the Kuala Lumpur High Court dated 18 July 2019 which had granted summary judgment in favour of Malaysia Airports (Sepang) Sdn Bhd (“MA Sepang”), a wholly owned subsidiary of the Company, in three civil suits filed by MA Sepang against AirAsia Berhad and AirAsia X Berhad (collectively, “AirAsia”). 

The Kuala Lumpur High Court’s summary judgment order had been for a combined amount of RM40,728,327.50 in unpaid Passenger Service Charges and a combined amount of RM792,381.74 in unpaid Late Payment Charges (collectively, “the High Court Judgment Sum”). 

The High Court Judgment Sum has already been paid by AirAsia to MA Sepang on 17 and 18 September 2019. 

Further to the above, the Court of Appeal dismissed AirAsia’s appeals to strike out MA Sepang’s three civil suits. 

The Court of Appeal awarded total costs in the sum of RM60,000.00 to MA Sepang.
